Applications and Websites Privacy Policy

AllTen Software Limited

1. We respect your privacy

1.1. AllTen Software Limited respects your right to privacy and is committed to safeguarding the privacy of our customers, software applications or apps ('Applications') and websites ('Websites') users. We adhere to the Privacy Principles contained in the New Zealand Privacy Act 2020 (the Act) and, where applicable to users in the European Union and European Economic Area, the General Data Protection Regulation (EU) 2016/679 (GDPR). This policy sets out how we collect and treat your personal information.

1.2. "Personal information" is information we hold which is identifiable as being about you.

2. Collection of personal information

2.1. AllTen Software Limited will, from time to time, receive and store personal information you enter onto our Applications and Websites, provided to us directly or given to us in other forms.

2.2. You may provide basic information such as your name, phone number, address, and email address to enable us to send information, provide updates and process your product or service order. We may collect additional information at other times, including but not limited to, when you provide feedback, when you provide information about your personal or business affairs, change your content or email preference, respond to surveys and/or promotions, or communicate with our customer support. We never receive or store your payment or credit card details - all billing for in-app purchases is handled by the app store (see Section 10.9).

2.3. Additionally, we may also collect any other information you provide while interacting with us.

2.4. Local-only storage (Applications): All archery data you enter into our Applications - including scores, journal entries, gear settings, and preferences - is stored locally on your device only. We do not transmit, sync, or store this data on any server. Uninstalling the Application will permanently delete all locally stored data from your device.

3. How we collect your personal information

AllTen Software Limited collects personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our Applications and Websites and when we provide our services to you. We may receive personal information from third parties. If we do, we will protect it as set out in this Privacy Policy.

4. Use of your personal information

4.1. AllTen Software Limited may use personal information collected from you to provide you with information, updates, and our services. We may also make you aware of new and additional products, services, and opportunities available to you. We may use your personal information to improve our products and services and better understand your needs.

4.2. Our Applications and Websites may make third party social media features available to its users. We cannot ensure the security of any information you choose to make public in a social media feature. Also, we cannot ensure that parties who have access to such publicly available information will respect your privacy.

4.3. AllTen Software Limited may contact you by a variety of measures including, but not limited to telephone, email, SMS or mail.

5. Legal basis for processing (GDPR)

Where the GDPR applies, we process personal information on the following legal bases:

5.1. Contract performance (Article 6(1)(b)) - Processing is necessary to provide the Application and its services to you, including storing your archery scores, journal entries, and gear data on your device.

5.2. Legitimate interest (Article 6(1)(f)) - We have a legitimate interest in improving app stability and fixing bugs through crash reporting (see Section 10.8). Crash reports contain only technical diagnostic data and no personally identifiable information.

5.3. Contract performance (Article 6(1)(b)) - Where you make an in-app purchase, processing your purchase and subscription status (see Section 10.9) is necessary to deliver the features you bought.

6. Disclosure of your personal information

6.1. We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers, or subcontractors insofar as reasonably necessary for the purposes set out in this Policy. Personal information is only supplied to a third party when it is required for the delivery of our services.

6.2. We may from time to time need to disclose personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, during a legal proceeding or in response to a law enforcement agency request.

6.3. We may also use your personal information to protect the copyright, trademarks, legal rights, property, or safety of AllTen Software Limited, its Applications, Websites, and customers or third parties.

6.4. Information that we collect may from time to time be stored, processed in, or transferred between parties located in countries outside of New Zealand. These may include but are not limited to the geographic locations of services provided by companies we use to provide our services.

6.5. If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances.

6.6. By providing us with personal information, you consent to the terms of this Privacy Policy and the types of disclosure covered by this Policy. Where we disclose your personal information to third parties, we will request that the third party follow this Policy regarding handling your personal information.

7. Security of your personal information

7.1. AllTen Software Limited is committed to ensuring that the information you provide to us is secure. To prevent unauthorised access or disclosure, we have put in place suitable physical, electronic, and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

7.2. The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

8. Your rights

You have rights regarding your personal information under the New Zealand Privacy Act 2020 and, where applicable, the GDPR. Because our Applications store all data locally on your device, many of these rights are inherently satisfied:

8.1. Access and rectification: All data you enter into our Applications is visible and editable directly within the app on your device. You may also request details of personal information that we hold about you by emailing support@archerysuccess.com.

8.2. Erasure (right to be forgotten): You can delete individual entries within the Application, or uninstall the Application to permanently delete all locally stored data. We do not retain any copy of your Application data on our servers.

8.3. Data portability: You can export your data in a structured, machine-readable format (CSV) using the "Export My Data" feature found in the Application under Settings > Legal. This export includes your profile, journal entries, gear, and custom rounds.

8.4. Restriction of processing and objection: As your Application data is stored and processed entirely on your local device, there is no server-side processing to restrict or object to.

8.5. Right not to be subject to automated decision-making: We do not use automated decision-making or profiling.

8.6. We reserve the right to refuse to provide you with information that we hold about you, in certain circumstances set out in the New Zealand Privacy Act 2020 (the Act).

9. Data retention

9.1. All archery data within our Applications (scores, journal entries, gear settings, custom rounds, and preferences) is stored locally on your device only. We do not retain any copy of this data on any server. Data is permanently deleted when the Application is uninstalled.

9.2. Backup files and data exports created by you (including "Export My Data" exports) are saved to locations you choose and are under your control. AllTen Software Limited has no access to these files.

10. Software Applications and Websites

10.1. When you use our Applications or Websites

When you use our Websites, we may collect certain information such as your IP address, operating system, the type of internet browser you use, and information about the way you use the Website. This information is used in an aggregated manner to analyse how people use our Websites, such that we can improve our service. Our Applications contain no advertising or usage-analytics SDKs: the only automatic collection in our Applications is the crash reporting described in Section 10.8 and the purchase processing described in Section 10.9.

10.2. Cookies and consent

We use cookies on our Websites. Cookies are very small files which a website uses to identify you when you come back to the Website and to store details about your use of the Website. Cookies are not malicious programs that access or damage your computer, tablet, or smartphone. We use consent management tools to give you control over cookies that are not strictly necessary: archerysuccess.com uses Cloudflare Zaraz, and alltensoftware.com uses CookieYes. If you are located in the European Union, European Economic Area, United Kingdom, or Switzerland, analytics cookies (see Section 10.10) are set only after you give consent through the consent banner shown on your first visit. You can change or withdraw your consent at any time via the "Cookie Settings" link in the footer of archerysuccess.com, or via the cookie consent controls on alltensoftware.com. You can also choose to reject cookies by changing your device settings. However, this may prevent you from taking full advantage of our Websites.

10.3. In-app promotions

Our Applications may display in-house promotional content for other products and services offered by AllTen Software Limited (such as ArcheryTimers). These promotions are served directly by us and do not involve any third-party advertising networks, tracking SDKs, or mobile advertising identifiers. No personal data is collected, shared, or transmitted to third parties for advertising purposes.

10.4. Automatic collection

Our Websites may collect certain information automatically, including, but not limited to, the type of device you use, your IP address, your operating system, the type of internet browser you use, and information about the way you use the Website. In our Applications, automatic collection is limited to the crash reporting described in Section 10.8 and the purchase processing described in Section 10.9.

10.5. Third parties

Our Applications or Websites may have links or provide functionality to upload data, to other applications or websites not owned or controlled by us. These links are meant for your convenience only. Links to third party applications and websites do not constitute sponsorship or endorsement or approval of these third parties. Please be aware that AllTen Software Limited is not responsible for the privacy practises of other such applications or websites. We encourage our users to be aware, when they leave our Application or Websites, to read the privacy statements of each and every application or website that collects personal identifiable information.

10.6. Contact and support forms

Our Websites use Web3Forms, a third-party form submission service, to process contact and support enquiries. When you submit a form, Web3Forms collects your IP address, email address, and the content of your submission. Your IP address is appended to the form submission and included in the support email delivered to us. This means your IP address is stored as part of our support correspondence. We retain support correspondence for the duration of our customer relationship to provide ongoing support and resolve recurring issues. Form submissions stored by Web3Forms itself are automatically deleted after 7 days; the email delivered to us remains our record of the correspondence. IP addresses may also be shared by Web3Forms with spam prevention services (such as CleanTalk) and are retained in Web3Forms server logs for up to two months before automatic deletion. By submitting a contact or support form, you consent to this data collection and retention. If you wish to have your support correspondence deleted, please contact us at support@archerysuccess.com. For more information, please refer to the Web3Forms Privacy Policy (opens in new tab).

10.7. Geo-location

Our Applications do not request or collect your device location. We do not use GPS or any similar location technology. If a future version adds a location-based feature (such as weather conditions for your shooting venue), it will ask for your permission first, and this policy will be updated in the same release to describe exactly what is collected. Separately from device location, crash reports may carry an approximate location (country, city) inferred from your IP address by Sentry's servers - see Section 10.8.

10.8. Crash reporting and diagnostics

Our Applications use Sentry, a third-party error monitoring service, to collect crash reports and diagnostic data for the purpose of improving app stability and fixing bugs. Crash reporting is always active and contains only technical data: stack traces, device type, and operating system version. The Sentry SendDefaultPii option is set to false, meaning no user names, email addresses, or cookies are collected or transmitted. However, when a crash report is sent, Sentry's servers may infer approximate geolocation (country, city) from your device's IP address at the time of transmission. The IP address itself is not stored. By installing the Application through the app store, you acknowledge this data collection as disclosed in the app store listing.

10.9. In-app purchases

All payment and billing for subscriptions and in-app purchases is handled by the app store you bought them from (Apple App Store or Google Play Store); we never receive or store your payment details. To match your purchase to the features it unlocks, our Applications use RevenueCat, a third-party subscription management service. RevenueCat processes: a randomly generated anonymous identifier for your app installation (not your name or email address), your purchase history and subscription status, store receipt information, and basic device information such as device model and operating system version. This data is used solely to unlock the features you purchased and to restore them when you reinstall or change device. RevenueCat does not receive your name, your email address, or any of your archery data. For more information, please refer to the RevenueCat Privacy Policy (opens in new tab).

10.10. Website analytics (Google Analytics)

Our Websites use Google Analytics, a web analytics service provided by Google, to understand how visitors use our Websites. Google Analytics uses cookies (see Section 10.2) to collect information such as the pages you visit, how long you stay, the type of device and browser you use, and your approximate location derived from your IP address. This information is processed by Google on our behalf in an aggregated form; we use it only for statistics about how our Websites are used. Google Analytics is used on our Websites only - our Applications do not contain Google Analytics or any similar analytics service (see Section 10.1). You can control Google Analytics through the cookie consent settings on our Websites - analytics only runs if you allow it there. The Google Analytics opt-out browser add-on (opens in new tab) may not be effective on our Websites, because analytics is loaded through our hosting provider rather than directly by your browser. For more information, please refer to the Google Privacy Policy (opens in new tab).

10.11. Website hosting (Cloudflare)

Our Websites are served through Cloudflare, a content delivery and security service. When you visit our Websites, Cloudflare processes technical request data - including your IP address, browser type, and the pages requested - in order to deliver the Websites, protect them against attacks and abuse, and cache content close to you. Cloudflare retains limited log data for security purposes. This applies to our Websites only; our Applications do not use Cloudflare. For more information, please refer to the Cloudflare Privacy Policy (opens in new tab).

11. Complaints and supervisory authority

11.1. If you have any complaints about our privacy practices, please feel free to send details of your complaints to support@archerysuccess.com. We take complaints very seriously and will respond shortly after receiving written notice of your complaint.

11.2. If you are located in the European Union or European Economic Area, you also have the right to lodge a complaint with your local data protection supervisory authority if you believe that our processing of your personal information infringes the GDPR.

12. Children's privacy

Our Applications are not directed at children under 13. As set out in our Terms of Use, you must be at least 13 years of age to use the Service, or use it with the consent and supervision of a parent or legal guardian. We do not knowingly collect personal information from children under 13 - all archery data stays on the device (see Section 2.4). If you believe a child has provided us with personal information, please contact support@archerysuccess.com and we will delete it.

13. Opt out right

You can stop all collection of information by our Applications by uninstalling the Applications and not using our Websites. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network to uninstall our Applications.

14. Changes to Privacy Policy

Please be aware that we may change this Privacy Policy in the future. We may modify this Privacy Policy at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our website or notice board. Please check back from time to time to review our Privacy Policy.
